Madras HC bans photos of living persons

The Madras high court Justice S Vaidyanathan banned using pictures of living persons on banners and hoardings in Tamil Nadu, including cut-outs of politicians and actors.

The court asked the government of Tamil Nadu to maintain a clean environment and also ensure for “no unnecessary drawings” on buildings and residential places in all wards of the southern state.

Even after permission is given by the authority concerned shall ensure that the photos/pictures of a living person shall not be placed on those banners, flex boards, signboards. The court has also barred the use of photos of people sponsoring the pictures.

The Court has taken the plea of Chennai resident B Thirulochana Kumari, who was facing problem due to political party banner erected in front of her home. Police also declined to accept her application and instead threatened her with a case of the scheduled castes and scheduled tribes (prevention of atrocities) act.

Court also asked the chief secretary to ensure clean surroundings of the Tamil Nadu open places (prevention of disfigurement) act, 1959, were amended from time to time.
